TERMS OF SERVICE

1. Subscription Services

By purchasing a membership from our website, you agree to recurring billing in accordance with the plan you selected. Membership perks and any in-store benefits are subject to these Terms and posted policies.

2. Eligibility and Accounts

You must be at least 13 years old to create an account. If you are under the age of majority in your state, you must have parent or guardian consent. You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate, current, and complete information and update it as needed.

3. Payment, Billing, and Price Changes

All payments are processed securely through Shopify’s payment gateway. By purchasing, you authorize recurring charges to your selected payment method until you cancel. Memberships renew each billing period unless canceled in advance. We may change prices or plan features with advance notice; continued membership after notice constitutes acceptance. Except where required by law, payments are non-refundable once processed.

4. Cancellation Policy

You may cancel your membership at any time through your account dashboard or by contacting us. Cancellation stops future renewals but does not refund the current term. We may modify, suspend, or discontinue membership features upon notice where feasible.

5. Account Responsibility

You are responsible for maintaining the confidentiality of your account and login credentials and for all activity that occurs under your account.

6. Birthday Rewards and Promotions

Birthday rewards are redeemable in-store only, subject to availability, and may require ID to verify eligibility. Rewards are personal, non-transferable, have no cash value, and are limited to one redemption per member per year. We may refuse, limit, or revoke rewards if we suspect fraud, abuse, or ineligibility.

7. Acceptable Use and Suspensions

You agree not to misuse the service, including attempting unauthorized access, creating fraudulent accounts, interfering with site operation, or violating any laws or regulations. We may suspend or terminate access for violations of these Terms or suspected fraud.

8. Intellectual Property

All content provided through our service—including text, images, graphics, and branding—is the property of Mirai Arcade and may not be copied, distributed, or used without prior written permission.

9. Availability and Third-Party Services

The site and memberships are provided "as is" and may be unavailable during maintenance or outages. Payments and certain account functions rely on third parties (including Shopify and Supabase); their terms may also apply. We are not responsible for third-party services we do not control.

10. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, Mirai Arcade will not be liable for indirect, incidental, special, or consequential damages. Our total liability for any claim arising out of or relating to these Terms or your membership will not exceed the amounts you paid for membership in the six (6) months before the claim.

11. Indemnity

You agree to indemnify and hold Mirai Arcade harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the services.

12. Changes to Terms

We may update these Terms from time to time. Changes will be effective when posted on our website. If we make material changes, we will provide notice (for example, by email or a site banner). Your continued use after changes means you accept the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute will be brought exclusively in the state or federal courts located in Orange County, Florida, and you consent to their jurisdiction and venue. If required by law, you may also bring claims in small claims court.

14. Communications and Marketing

By creating an account, you agree that we may send you transactional emails about your membership. Marketing emails are optional; you can opt out at any time via the unsubscribe link or your account settings. Promotional SMS (if offered) will be subject to separate consent and message/data rates from your carrier.

15. Force Majeure

We are not liable for delays or failures to perform caused by events beyond our reasonable control, including natural disasters, power outages, network failures, labor disputes, or governmental actions.

16. Severability and Waiver

If any part of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce any provision is not a waiver of our right to do so later.

17. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

18. General Arcade and Retail Terms

Eligibility: You must be at least eighteen (18) years old or have the supervision of a parent or guardian to participate in arcade games or make purchases from our retail section. Our broader account eligibility still requires a minimum age of 13 with guardian consent where applicable.

Code of Conduct: Treat guests and staff respectfully and avoid damaging arcade machines, merchandise, or facilities. We may refuse service or remove individuals who violate these guidelines.

19. Arcade Usage

Game Play: All claw machine games are based on chance; outcomes cannot be altered or guaranteed.

Credits: Games require credits purchasable on-site. Credits are non-refundable, have no cash value, and misuse or tampering with machines may result in penalties, including being asked to leave the premises.

Prize Redemption: Prizes can be collected immediately and are not exchangeable or returnable except for defective prizes, which we will replace with the same or equivalent value when available.

20. Retail Purchases

Products: Our retail section offers items such as blind boxes, Gundams, figurines, and more. Availability may be limited.

Blind Box Policy: Blind boxes are sold as-is and cannot be opened prior to purchase. Once opened, returns or exchanges are not allowed unless the item is defective or damaged.

Pricing: Prices are listed in USD and may include taxes unless stated otherwise. Prices can change without prior notice.

Returns & Exchanges: All retail sales are final and not eligible for return or exchange, except for defective or damaged items where required by law.

21. Liability

Arcade Games: Use machines at your own risk and follow posted instructions. We are not responsible for injuries, accidents, or losses that occur during the use of arcade games.

Retail Items: We are not liable for damages resulting from the use or misuse of retail items, including collectibles and figures. This section complements the limitation of liability above.

22. Privacy

When you make purchases or participate in promotions, we may collect personal information such as name, email, and payment details. See our Privacy Policy for how we collect, use, and protect your data. We do not sell personal information.

23. Modifications to Terms

We may modify these Terms at any time. Changes are effective when posted on this page. It is your responsibility to review the Terms periodically; continued use after changes means you accept the updated Terms.

24. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida. Any disputes or claims arising from your use of our services shall be resolved in the courts of Orange County, Florida (or small claims court where permitted).
